TERMS AND CONDITIONS

  1. GENERAL PROVISIONS

These Terms and Conditions of Sale ("Terms of Sale") together with the Return Policy and Privacy Policy govern the offer and sale of artwork on the online store www.davidecristofaro.com (hereinafter "Site"). The works of art featured on the Website www.davidecristofaro.com are sold directly by Davide Cristofaro Limited (hereinafter referred to as "Seller"), a company registered in England and Wales under No. 9685798, with registered office at 13 St. Swithin's Lane, 2nd Floor, London, EC4N 8AL, United Kingdom.   1. CONSUMER INFORMATION

2.1 The works of art presented on this Site are offered for sale to consumers natural persons over the age of 18 (hereinafter referred to as the "Consumers" or the "Consumer") who are acting for purposes unrelated to their trade, craft, business or professional activity, if any. Artwork may not be purchased by natural persons under the age of 18 years unless with the permission and supervision of a parent or guardian. Seller does not knowingly collect personal information on the Site from or about minors.

2.2 Before confirming and sending the purchase order, the Consumer shall carefully read these Terms of Sale. These Terms of Sale exclusively govern the offer and acceptance of purchase orders for artwork on the davidecristofaro.com store between users of the davidecristofaro.com store and the Seller.

2.3 The Conditions of Sale do not regulate the provision of services or sale of products by parties other than the Seller that are present on the davidecristofaro.com store through links, banners or other hypertext links. You are advised, before placing orders and purchasing products and services from parties other than the Seller, to check their Terms of Sale, as the Seller is not responsible for the provision of services by third parties other than the Seller or for the conclusion of e-commerce transactions between users of the store davidecristofaro.com and third parties. The Conditions of Sale and Privacy Policy (hereinafter "Privacy Policy") constitute the rules that govern the contract between the Consumer and the Seller concluded at a distance through the use of the Site.

  1. PURCHASING PROCEDURE

3.1 The Site displays, for each selected artwork, a picture of the artwork, unit price, dimensions, and other relevant features.

3.2 The Consumer will be able to select the artwork(s) he/she is interested in. The work selected for purchase will be loaded into the appropriate "shopping cart". It is not possible to select a work by loading it into the cart and save the cart to proceed with the purchase in a subsequent Internet session. If the purchase procedure is not completed, the contents of the cart will be deleted. The sales procedure will be considered completed when the Seller receives, by electronic means, the order form, after verification of the correctness of the data relating to the order.

3.3 In order to proceed with the purchase of the works, the Consumer shall complete and send to the Seller the form with the order proposal in electronic format (hereinafter "Order Form"), following the instructions contained in the Site. The Consumer shall place the work in the "shopping cart" and, after viewing and accepting the General Conditions, the summary of information on the essential characteristics of each work ordered, the details of delivery costs, the conditions on the right of withdrawal (hereinafter "Right of Withdrawal Policy"), as well as the Privacy Policy, shall select the payment method and choose the option "I confirm my order".

3.4 By submitting the Order Form electronically, the Consumer accepts and agrees to abide by these Conditions of Sale in the performance of the contract with the Seller. If the Consumer does not agree with any of the terms stated in the Conditions of Sale, the Consumer is requested not to submit the Order Form for the purchase of the works on the Site.

3.5 If the Consumer needs to correct any data entry errors, he/she shall follow the appropriate editing procedure indicated on the Site, before submitting his/her Order Form. By submitting the Order Form, the Consumer acknowledges and declares that he/she has read all the information provided to him/her during the purchase procedure and that he/she accepts the General Conditions in full, as they will be binding once the purchase is concluded.

3.6 Upon completion of the purchase process, the Consumer will receive an email to the address entered in the Order Form confirming the order placed, acceptance of the Privacy Policy as well as the Right of Withdrawal Policy. The Order Form will be stored in the Seller's database located in the United Kingdom for at least as long as necessary to process orders and otherwise within the terms and conditions of applicable law. The Consumer will be able to access their Order Form by going to the "My Account" section or by contacting Customer Service.

3.7 The Seller reserves the right to reject orders issued by purchasers whom it considers ineligible or with whom there is a pending legal dispute concerning a previous order or for any other legitimate reason, without any need to provide a reason. Seller reserves the right to limit or not execute orders that, in its sole discretion, appear to be sent by resellers and/or distributors.

  1. WARRANTIES AND PRODUCT FEATURES

4.1 Artworks designed and made exclusively in Italy by Davide Cristofaro are offered for sale on the davidecristofaro.com store.

4.2 The Seller does not sell used, irregular, or substandard works below the corresponding standards offered in the market.

4.3 The essential characteristics of the works are presented on the store davidecristofaro.com within each product sheet. However, the images and colors of the works offered for sale on the store davidecristofaro.com may not correspond to the real ones due to the effect of the Internet browser and monitor used.

4.4 The images contained on the store davidecristofaro.com are the exclusive property of the Seller. Any use of the images of the works, where not expressly authorized with written consent from the Seller, will be prosecuted to the fullest extent of the law.

4.5 Prices of works may be subject to update. Be sure of the final sale price before submitting the relevant order form.

4.6 Purchase requests from countries other than the country selected for shipment or to addresses to which Seller cannot ship cannot be accepted by Seller.

4.7 All works have a certificate of authenticity, certificate of guarantee and, if applicable, an identification tag attached with a disposable seal. It is requested not to remove the tag and its seal from the purchased works, of which they are an integral part.

4.8 The Seller, in the event of the exercise of the right of withdrawal, has the right not to accept the return of works that are without the relevant tag or that have been altered in their essential and qualitative characteristics or that have been damaged.

  1. PRICE AND PAYMENT

5.1 Artwork prices, shipping and delivery charges are quoted in Euros and include all applicable tax charges.

5.2 The price of the artwork does not include shipping costs, which will be calculated and charged before the order is confirmed by the Consumer.

5.3 The total amount of the order will then be displayed before the order is confirmed and submitted.

5.4 Payment for the works purchased on the Site will be made by credit card, Paypal, bank transfer or other methods indicated on the Site. Financial information (e.g., the number of the credit/debit card or the date of its expiration) will be forwarded, via encrypted protocol, to banks or other financial institutions, which provide the relevant remote electronic payment services, without third parties being able to access it in any way. Moreover, this information will never be used by the Seller except to complete the procedures relating to the purchase by the Consumer or to issue the relevant refunds in the event of any returns of the works, following the exercise of the right of withdrawal, or if it is necessary to prevent or report to the police the commission of fraud on the Site.

  1. SHIPMENT AND DELIVERY OF WORKS

6.1 To learn about the specific shipping and delivery methods for the works, please access the "Shipping and Delivery" section of the Site. Please pay attention to what is stated in this section as the information contained therein forms an integral part of these Conditions of Sale and, therefore, shall be deemed to be fully known and accepted by you at the time you submit your order form.

  1. RIGHT OF WITHDRAWAL AND REFUNDS

7.1 The Consumer has the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within fourteen (14) working days from the day of receipt of the works purchased on the store davidecristofaro.com.

7.2 To exercise the right of withdrawal, the Consumer must send an e-mail to the address [email protected], indicating the order number and the works you wish to return. The Seller will send an acknowledgement of receipt of the return request via e-mail.

7.3 The Consumer shall return the works to the Seller by delivering them to the courier for shipment within fourteen (14) business days of receipt of the works. The works must be returned undamaged, unused, in the original packaging, with the identification tag and seal still attached. Shipping costs for the return of works are the responsibility of the Consumer.

7.4 The Seller will refund the price of the returned works, including the initial shipping costs, within fourteen (14) days from the day it receives the returned works from the Consumer, using the same payment method used by the Consumer for the initial transaction, unless otherwise agreed.

7.5 There is no right of withdrawal for custom artwork or artwork created on commission. These items cannot be returned or refunded unless they have conformity defects or hidden defects.

  1. APPLICABLE LAW AND JURISDICTION

8.1 These Terms of Sale are governed by and shall be construed in accordance with English law, including, without limitation, the Sale of Goods Act 1979 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, without regard to conflicts of law and the principles of the United Nations Convention on Contracts for the International Sale of Goods.

8.2 Any dispute arising out of the interpretation, validity and/or performance of these Terms of Sale shall be subject to the exclusive jurisdiction of the courts of London, subject to the mandatory jurisdiction of the Consumer.
